The Supreme Court on Friday deferred the hearing of a petition filed by the CBI against an order of the Kerala High Court. The next hearing on the matter will be on July 27.
The High Court had quashed the 60-day time limit on pre-arrest bail granted by the sessions court to former DGP Sibi Mathews in the ISRO espionage case.
The High Court had passed the order on Mathews’ plea challenging the condition of limiting the period of anticipatory bail to 60 days.
The CBI’s petition against the High Court order came up for hearing on Friday before a bench of Justices AM Khanwilkar and JB Pardiwala.
Additional Solicitor General (ASG) S.V.Raju, appearing for the CBI, said it should be clubbed with the pending petitions filed by the probe agency against the High Court’s order granting anticipatory bail to four other persons in the case.
The bench said that it will hear these matters on July 27. The High Court, in its order, had said, “In order to ensure justice in such circumstances, it is appropriate that the said time limit of 60 days be removed.”
CBI had earlier also moved the Supreme
Earlier, the CBI had moved the Supreme Court against the order of the High Court on August 13 last year. The matter is also pending. The High Court had on August 13 last year granted anticipatory bail to former Gujarat DGP RB Sreekumar, two former Kerala police officers S Vijayan and Thampi S Durga Dutt and a retired intelligence officer PS Jayaprakash in the case.
Sreekumar was then the Deputy Director of the Intelligence Bureau. The Supreme Court had in November last year issued notice on the CBI’s plea against the August 13 order last year.
Space program went back a decade or two: CBI
The CBI had earlier told the Supreme Court that it had found in its investigation that some scientists were tortured and implicated in the case, which affected the development of the cryogenic engine and caused India’s space program to lag by almost a decade or two. Gone.
CBI has registered cases against 18 people
The CBI has registered cases against 18 people for various alleged offenses, including criminal conspiracy, in connection with the arrest and custody of former ISRO scientist Nambi Narayanan.
The case, which made headlines in 1994, pertains to allegations of transfer of some confidential documents on India’s space program abroad. Nambi Narayanan has been given a clean chit by the CBI. He had earlier said that the Kerala Police had ‘fabricated’ the case and the technology alleged to have been stolen and sold in the 1994 case was not even present at that time.
The CBI, in its investigation, had said that the then top police officers of Kerala were responsible for the illegal arrest of Narayanan. The Supreme Court had appointed a three-member committee on September 14, 2018, while directing the Kerala government to pay a compensation of Rs 50 lakh for forcing Narayanan to “extremely humiliate”.
